These Terms of Use (“Terms”) govern your access to and use of Slabline, a web application operated by Hobby Smart Case, Inc. (“Slabline,” “we,” “us,” or “our”) that provides a credit-style risk index, comparable-sales valuations, and insurance documentation for graded trading-card collections (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
2. What Slabline Is — and Is Not
Slabline is an informational tool. The Slabline Score™, valuations, coverage-gap figures, risk factors, and insurance schedules are estimates generated from data you provide and from third-party market sources. They are provided for your general information and recordkeeping convenience only.
In summary, Slabline does not, and the Service does not:
- Provide insurance, act as an insurer, agent, broker, or producer, or bind, procure, or guarantee any coverage;
- Provide an appraisal, or a certified or guaranteed statement of value;
- Provide financial, investment, tax, legal, or insurance advice; or
- Guarantee the accuracy of any valuation, comparable sale, or market figure.
Valuations and the Insurance Schedule & Risk Report. Slabline generates estimated values, a Slabline Score™, and an “Insurance Schedule & Risk Report” using automated methods applied to data obtained from third-party sources, including publicly reported and marketplace comparable sales. These outputs are provided “as is” and “as available,” for informational and organizational purposes only. Slabline is not a licensed or certified appraiser, and the values, scores, and reports it generates do not constitute a professional, certified, or independent appraisal within the meaning of any appraisal standard (including USPAP) or applicable law. Card values are volatile and depend on factors Slabline does not observe or verify, including condition changes, authenticity, market timing, and the accuracy of third-party data. Slabline does not warrant that any value, score, or report is accurate, complete, current, or fit for any particular purpose, including establishing insurance coverage limits, setting a sale or purchase price, or any financial or tax determination. You are solely responsible for verifying any value or report with a qualified, independent appraiser and your insurer before relying on it.
No insurance products or advice. Slabline is not an insurance company, insurance producer, agent, broker, or adjuster, and is not licensed to transact insurance in any jurisdiction. Nothing in the Service constitutes the solicitation, negotiation, sale, or placement of insurance, or insurance, legal, or financial advice. Features that reference “insurance,” “coverage,” “coverage gaps,” “schedule,” or “risk,” including the Insurance Schedule & Risk Report, are provided only to help you organize and document your collection so that you can discuss coverage with a licensed insurer or broker of your choosing. Slabline does not determine your coverage needs, does not recommend any insurer or policy, and does not guarantee that any item is or will be covered. Any decision to obtain, change, or rely on insurance is solely between you and your licensed provider.
The Slabline Score™ is informational only. The Slabline Score™ is a proprietary, automated index (0–1000) that summarizes certain risk-related factors about a graded-card collection for the user’s own informational and organizational use. The Score is not a consumer credit score, credit rating, or consumer report, is not a “credit score” or “credit rating” within the meaning of the Fair Credit Reporting Act (FCRA) or any similar law, and is not used or intended to be used to determine eligibility for credit, insurance, employment, or any similar purpose. The Score does not constitute investment, financial, tax, legal, accounting, or insurance advice, and should not be relied upon as the basis for any transaction. Slabline does not warrant that the Score is accurate, complete, or suitable for any purpose, and the methodology may change at any time without notice. Any references to a “credit-style” index are by analogy only and do not imply that the Score is a regulated credit product.
You are responsible for your own insurance, financial, and collecting decisions, and should consult a licensed professional (such as a qualified appraiser, insurance broker, or advisor) before relying on any output of the Service. Final coverage terms are always determined by your insurer and underwriter, not by Slabline.
3. Accounts and Security
Account creation and authentication are handled through our identity provider (including optional sign-in with Apple or Google). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at brian@hobbysmartcase.com if you suspect unauthorized use.
4. Your Content
“Your Content” means the data you submit to the Service, including card records, grades, costs, storage details, and self-reported insurance information. You retain all ownership of Your Content. You grant us a limited, non-exclusive, worldwide license to host, process, and display Your Content solely to operate, secure, and improve the Service and to generate the outputs you request (such as scores and insurance schedules).
You represent that you have the rights necessary to submit Your Content and that it does not violate any law or third-party right.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or deceptive purpose, including misrepresenting values to an insurer or third party;
- Attempt to access, scrape, reverse engineer, or disrupt the Service or its underlying systems;
- Resell, sublicense, or commercially exploit the Service without our written permission; or
- Upload malware or content that infringes the rights of others.
6. Subscriptions and Fees
Certain features are offered under paid tiers. Pricing, included features, and billing terms are presented in the Service at the time of purchase. Fees are non-refundable except where required by law or expressly stated. We may change pricing prospectively with reasonable notice.
7. Intellectual Property
The Service, including the Slabline name and logo, the Slabline Score™ methodology, software, and report designs, is owned by Hobby Smart Case, Inc. and protected by intellectual-property laws. Except for Your Content and the rights expressly granted to you to use the Service, no rights are transferred to you.
8. Third-Party Services and Data
The Service relies on third-party providers for authentication, hosting, data storage, and market data. We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them may be subject to their own terms.
9. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT VALUATIONS, SCORES, OR REPORTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, INCLUDING INSURANCE UNDERWRITING.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOBBY SMART CASE, INC. AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR COVERAGE, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless Hobby Smart Case, Inc. from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
13. Changes to the Terms or Service
We may modify the Service or these Terms from time to time. If we make material changes, we will update the “Effective” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their personal jurisdiction.
